Payment Instructions:

Abal Auction Real Estate accepts Visa and MasterCard only. A 15% online buyer's premium will be added to all sales conducted via Proxibid. There will be no sales tax charged for online sales unless you live within the boundaries of Florida. 7% sales tax will apply unless you have a Florida resale number on file with Abal Auction Real Estate prior to auction time. Your credit card will automatically be charged within 36 hours of the end of the auction. A separate charge will appear for shipping. A $30 processing fee will be assessed if your credit card on file with Proxibid is declined. Proxibid allows up to three credit cards, but the auction company only receives the default card or the one you choose. You will receive a Proxibid black flag if your credit card is declined and we cannot contact you within three (3) days after the auction.

Shipping Instructions:

All items to be shipped by a third party shipper. If you would like to pick up your items please notify the auction company. No liability, warranty or guarantee will be offered or accepted, relative to shipping. Any breakage is the responsibility of the buyer and claims should be made directly to the third party shipper. All questions about shipping service or requests for additional shipping service should be directed to Amazing Mail Solutions, Crawfordville, Florida 32327. All items marked ‘pick up only' must be picked up at the designated storage location within 48 hours of the auction concluding. The rate for those items not picked up within 48 hours is an additional $15.00/day storage. Items left after 15 days will be resold.

Terms & Conditions:

1.  All items are sold as is, where is, no warranties or guarantees expressed or implied. All descriptions provided are for informational purposes only and should not be interpreted as creating any representation or warranty.  All merchandise is either new, used or consigned.  SALES ARE FINAL - NO RETURNS OR CHARGE BACKS ALLOWED.

2.   This auction will feature online Internet bidding only.  Bids will be accepted during the auction until each item is sold. 

3.  You must be pre-registered with a credit card on file to bid.  Buyer must acknowledge all terms of the auction and agree not to retract the purchase offer.  If you cannot satisfy the terms of the auction, please do not bid. 

4.  Terms of payment are MasterCard and Visa.  All items are sold as-is, where-is without any expressed or implied warranty.  No adjustments, returns or refunds will be issued.

5.  15% Buyer's Premium will be charged on all items sold to the buyer/winning bid.  All sales are subject to appropriate state sales tax laws.

6.  All announcements made on the website take precedence over any printed material.

7.   Successful bidders will receive an e-mail message within 24 hours of the auction.

8.  Abal Auction Real Estate reserves the right to reject any and all bids if they so choose.

9.  Internet bids are a contract and you are responsible for honoring them.  Every legal remedy available will be used to insure the performance of winning bidders. Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless each seller and auctioneer and their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses including reasonable attorneys' fees and expenses related to, arising from or associated with buyer's, his agents or representatives, use of the site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder of this site user agreement or any use by bidder of the site or as a result of a dispute with another bidder.

10.  No items will be released until full payment has been received. Merchandise becomes the full responsibility of buyer at the close of the auction, and buyer assumes all risk of loss and damage to property.

11.  We strive to take accurate photographs and give complete descriptions, including any faults.  If you are unsure as to the condition of an item, e-mail us at info@abalauctioncompany.com for more information.  If still unsure, don't bid.  The auctioneer and his consignors do not accept any returns or grant any credits.  All items are sold as is, where is.

13.  A 10% credit card hold may be applied to bids to ensure performance. If the terms of the auction are not followed, Abal Auction Real Estate reserves the right to charge the entire amount due to the credit card on file including any storage fees and penalties.

14.  In no event will our liability to a purchaser exceed the purchase price actually paid.

By acceptance of these terms and conditions, the buyer agrees to all of the terms and conditions of the auction
