Auction Terms
At the conclusion of the auction, item (lot) must be confirmed as sold by the seller's representative. The high bidder may not assume that the item is sold until notification is received from the auction company that the bid has been accepted and confirmed by the seller's representative. The successful bidder will be notified within 24-48 hours of the conclusion fo the auction.
1. Item is sold as is, where is, no warranties or guarantees expressed or implied. All descriptions provided are for informational purposes only and should not be interpreted as creating any representation or warranty. All merchandise is either new, used or consigned. SALES ARE FINAL - NO RETURNS OR CHARGE BACKS ALLOWED. 2. This auction will feature online Internet bidding only. Bids will be accepted during the auction until the item is sold. 3. You must be pre-registered with a credit card on file to bid. Buyer must acknowledge all terms of the auction and agree not to retract the purchase offer. If you cannot satisfy the terms of the auction, please do not bid. 4. Terms of payment are MasterCard and Visa for the first $2,000.00. Item is sold as-is, where-is without any expressed or implied warranty. No adjustments, returns or refunds will be issued. If you do not have sufficient financial resources to pay for your bid, DO NOT BID. 5. 15% Buyer's Premium will be charged on the item sold to the buyer/winning bid. All sales are subject to appropriate state sales tax laws. 6. All announcements made on the website take precedence over any printed material. 7. Successful bidders who are approved and confirmed by the Personal Representative will receive an e-mail message within 24 hours of the auction. 8. Abal Auction Real Estate reserves the right to reject any and all bids if they so choose. 9. Internet bids are a contract and you are responsible for honoring them. Every legal remedy available will be used to insure the performance of winning bidders. Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless each seller and auctioneer and their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses including reasonable attorneys' fees and expenses related to, arising from or associated with buyer's, his agents or representatives, use of the site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder of this site user agreement or any use by bidder of the site or as a result of a dispute with another bidder. 10. Item will not be released until full payment has been received. Merchandise becomes the full responsibility of buyer at the close of the auction, and buyer assumes all risk of loss and damage to property. 11. We strive to take accurate photographs and give complete descriptions, including any faults. If you are unsure as to the condition of an item, e-mail us at info@abalauctioncompany.com for more information. If still unsure, don't bid. The auctioneer and his consignors do not accept any returns or grant any credits. All items are sold as is, where is. A $2,000.00 restocking fee will be charged. 12. If you have any questions prior to bidding, please e-mail us at info@abalauctioncompany.com. 13. A 10% credit card hold may be applied to bids to ensure performance. If the terms of the auction are not followed, Abal Auction Real Estate reserves the right to charge the entire amount due to the credit card on file including any storage fees and penalties. 14. In no event will our liability to a purchaser exceed the purchase price actually paid. 15. Upon successful settlement and receipt of payment in Abal Auction escrow the item must be picked up within two weeks of that date or a storage fee of $30.00 per day will be charged. 16. Merchandise must be removed in accordance with the terms and conditions of the auction pick up schedule. A paid receipt must be presented to remove item from the Abal Auction facility. Buyers who incur storage fees as a result of late pickups must present a paid receipt for the total invoice price and all storage fees before removing item from the premise. Items not removed after 30 days will be considered abandoned property, with all the buyer's rights and interests in the property extinguished. Abal Auction Real Estate and/or seller reserve the right to pursue all legal remedies.
By acceptance of these terms and conditions, the buyer agrees to all of the terms and conditions of the auction. If you are unable to comply with any terms and conditions do not bid.
